By accessing and using PushTalk, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

2. Description of Service

PushTalk is a real-time push-to-talk communication application that allows users to:

• Create and join temporary voice chat rooms
• Communicate via push-to-talk functionality
• Use peer-to-peer WebRTC audio transmission

3. User Responsibilities

You agree to:

• Use the service only for lawful purposes
• Not engage in harassment, abuse, or threatening behavior
• Not transmit illegal, harmful, or offensive content
• Not attempt to disrupt or compromise the service
• Respect other users' privacy and rights
• Be at least 13 years of age to use this service

4. Privacy and Data

PushTalk is designed with privacy in mind:

• We do NOT record or store your conversations
• Audio is transmitted peer-to-peer between users
• Room codes and display names are temporary and not permanently stored
• We only store minimal preferences (dark mode) in your browser

5. Prohibited Activities

You may NOT use PushTalk to:

• Engage in illegal activities
• Harass, threaten, or harm others
• Transmit spam, malware, or malicious content
• Impersonate others or misrepresent your identity
• Violate intellectual property rights
• Attempt to hack, reverse engineer, or exploit the service

6. Service Availability

PushTalk is provided "as is" without warranties. We do not guarantee uninterrupted service and reserve the right to modify, suspend, or discontinue the service at any time.

7. Limitation of Liability

PushTalk and its operators are not liable for any damages arising from your use of the service, including but not limited to data loss, service interruptions, or user-generated content.

8. User Content

You are solely responsible for the content you transmit through PushTalk. We do not monitor, moderate, or control user communications. Any content you share is at your own risk.

9. Termination

We reserve the right to terminate or suspend access to the service for any user who violates these Terms of Service, without prior notice.

10. Changes to Terms

We may update these Terms of Service at any time. Continued use of the service after changes constitutes acceptance of the new terms.

11. Intellectual Property

PushTalk and its original content, features, and functionality are owned by the service operators and are protected by international copyright, trademark, and other intellectual property laws.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of any content

13. Indemnification

You agree to indemnify and hold harmless PushTalk and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, your violation of these terms, or your violation of any rights of another party.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the service shall be resolved through:

• Good faith negotiation between parties
• Binding arbitration if negotiation fails
• Small claims court for disputes under jurisdictional limits

You waive any right to participate in class action lawsuits or class-wide arbitration.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and PushTalk regarding the use of the service, superseding any prior agreements.
